End User Licence Agreement

1. Parties & Definitions

"Licensor" means Saurabh Infosys, a company registered in India with its principal place of business at 415, Aastha 99, Bh. Bharvi Tower, Kailash Colony, C.T.M, Amraiwadi, Ahmedabad, Gujarat 380026, India.

"Application" means the GrowDaily mobile software application and any updates, modifications, or enhancements thereto.

"You" or "End User" means the individual who downloads, installs, or uses the Application.

"Device" means the mobile phone, tablet, or other device on which the Application is installed.

2. Grant of Licence

Subject to your compliance with this EULA and payment of any applicable fees, Saurabh Infosys grants you a limited, non-exclusive, non-transferable, revocable licence to:

• Download and install the Application on one or more Devices that you personally own or control.
• Use the Application for your personal, non-commercial purposes.

This licence does not include any rights to use the Application for commercial purposes or to distribute it to third parties.

3. Licence Restrictions

You may not:

• Copy, modify, adapt, translate, or create derivative works based on the Application.
• Reverse-engineer, disassemble, decompile, or attempt to extract the source code of the Application.
• Sell, sublicence, rent, lease, transfer, or assign the Application or any rights therein to any third party.
• Remove or alter any proprietary notices, labels, or marks on the Application.
• Use the Application for any unlawful purpose or in violation of any applicable laws or regulations.
• Use automated tools, bots, or scrapers to access or interact with the Application.
• Interfere with or disrupt the integrity or performance of the Application or associated servers.

4. Ownership

The Application and all copies thereof are proprietary to Saurabh Infosys and title thereto remains with Saurabh Infosys at all times. All applicable intellectual property rights (including copyrights, patents, trademarks, and trade secrets) in and to the Application are and shall remain the sole and exclusive property of Saurabh Infosys.

This EULA grants you a licence only. It does not convey to you any ownership interest in or to the Application.

5. Updates & Maintenance

Saurabh Infosys may, from time to time, develop and provide updates for the Application. These updates may include bug fixes, feature enhancements, or new versions. You agree that Saurabh Infosys has no obligation to provide any updates or to continue providing or enabling any particular features of the Application.

By installing an update, you agree that the update shall be subject to the terms of this EULA unless a separate licence agreement is provided with the update.

6. Third-Party Services

The Application may use or integrate with third-party services (such as Apple Sign-In, Google Sign-In, or analytics providers). These services are governed by their own terms and privacy policies. Saurabh Infosys is not responsible for the practices of third-party service providers.

Links to third-party services within the Application are provided for convenience only and do not constitute endorsement.

7. Data & Privacy

Your use of the Application involves the collection and processing of certain personal data as described in our Privacy Policy, available at growdaily.app/privacy-policy.

By using the Application, you consent to the collection and use of your data as set out in the Privacy Policy, which is incorporated into this EULA by reference.

8. App Store Terms

This EULA is entered into between you and Saurabh Infosys only — not with Apple Inc. or Google LLC ("App Store Providers"). The App Store Providers are not responsible for the Application or its content.

In the event of any conflict between this EULA and the usage rules set forth in the applicable App Store terms, the App Store terms shall take precedence only to the extent of the conflict.

The App Store Providers are third-party beneficiaries of this EULA and may enforce it against you.

Saurabh Infosys, not the App Store Providers, is responsible for addressing any claims relating to the Application, including product liability, legal compliance, or consumer protection claims.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAURABH INFOSYS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Saurabh Infosys does not warrant that the Application will meet your requirements, operate without interruption, or be error-free. Saurabh Infosys makes no representations about the accuracy, reliability, completeness, or timeliness of any content within the Application.

The Application is intended for personal growth and confidence-building purposes only and is not a substitute for professional medical or psychological advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAURABH INFOSYS, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of data, loss of profits, loss of goodwill;
• Personal injury or property damage arising from your use of or inability to use the Application.

Our aggregate liability to you shall not exceed the total amount paid by you to Saurabh Infosys in the twelve (12) months preceding the claim, or INR 500 (whichever is greater).

11. Indemnification

You agree to indemnify, defend, and hold harmless Saurabh Infosys and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Application in violation of this EULA.
• Your violation of any applicable law or regulation.
• Your infringement of any third-party rights.

12. Term & Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically and without notice if you fail to comply with any of its terms.

Upon termination, you must cease all use of the Application and destroy all copies, full or partial, of the Application on your devices.

Sections 4, 9, 10, 11, and 13 shall survive any termination of this EULA.

13. Governing Law & Disputes

This EULA shall be governed by and construed in accordance with the laws of India, without giving effect to any choice of law or conflict of law provisions.

Any disputes arising under or in connection with this EULA shall be submitted to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

14. Miscellaneous

Entire Agreement: This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Saurabh Infosys concerning the Application.

Severability: If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Failure to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision.

Assignment: You may not assign this EULA or any rights hereunder without the prior written consent of Saurabh Infosys.
